AN ACT ESTABLISHING THE CHEROKEE NATION TRIBAL YOUTH COUNCIL ACT

BE IT ENACTED BY THE CHEROKEE NATION:

 

Section 1.                     Title and Codification

 

This act shall be known as the “Cherokee Nation Tribal Youth Council Act” and codified at Title 70, Chapter 4 of the Cherokee Nation Code. 

 

Section 2.                     Purpose

 

The purpose of this act is to provide for the codification of the youth leadership program for Cherokee Nation students in the fourteen counties of the Cherokee Nation Reservation previously established as the Youth Leadership Program under the Indian Education Act. 

                     

Section 3.                     Legislative History

 

Article VI, Section 7 of the Cherokee Nation Constitution states that the Council shall have the power to establish laws which it shall deem necessary and proper for the good of the Nation.  The Youth Leadership Program was established under the Indian Education Act pursuant to Resolution No. 94-89. 

 

Section 4.                     Findings

                                          

The Council of the Cherokee Nation finds that:

 

1.                     The Cherokee Nation Education Department has previously established a need for a youth leadership program for Indian students in the fourteen counties of the Cherokee Nation Reservation; and

 

2.                     The Youth Leadership Program was previously expanded to reach Cherokee youth and communities within the Cherokee Nation’s jurisdictional areas; and

 

3.                     The Youth Leadership Program was previously funded under the Indian Education Act establishing the Youth Leadership Program; and

 

4.                     The Youth Leadership Program should be codified to preserve its purpose and funding.

CHEROKEE NATION TRIBAL YOUTH COUNCIL ACT

§ 501. Short title

 

This act shall be known and may be cited as the Cherokee Nation Tribal Youth Council Act.

 

§ 502. Purpose

 

The purpose of this act is to provide for the preservation of the purpose and funding of the Cherokee Nation Tribal Youth Council previously established as the Youth Leadership Program under the Indian Education Act.

 

§ 503. Tribal Youth Council

 

A.  A Cherokee Nation Tribal Youth Council is hereby created to develop leadership in Cherokee youth within the fourteen counties of the Cherokee Nation Reservation and At Large.  This Cherokee Nation Tribal Youth Council shall be funded and administered pursuant to the Youth Leadership Program as previously established under the Indian Education Act.

 

B. The members of the Cherokee Nation Tribal Youth Council shall be provided a monthly stipend to be paid after the first meeting of each month.  The monthly stipend for Tribal Youth Council members shall be one hundred dollars ($100.00).

 

Section 6.                     Provisions as Cumulative

 

The provisions of this act shall be cumulative to existing law.

 

Section 7.                     Severability

 

The provisions of this act are severable and if any part or provision hereof shall be held void the decision of the Court so holding shall not affect or impair any of the remaining parts or provisions of this act.

 

Section 8.                     Effective Date/Emergency Declared

 

It being immediately necessary for the welfare of the Cherokee Nation, the Council hereby declares that an emergency exists, by reason whereof this act shall take effect and be in full force after its passage, approval and passage of a budget appropriation.

 

 

Section 9.                      Self-Help Contributions

 

To the extent that this Act involves programs or services to citizens of the Nation or others, self-help contributions shall be required, unless specifically prohibited by the funding agency, or a waiver is granted due to physical or mental incapacity of the participant to contribute.
