A RESOLUTION CERTIFYING COMPLIANCE WITH 24 CFR § 1003.604 CITIZEN PARTICIPATION
Body
WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government on behalf of the Cherokee people;
WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;
WHEREAS, the Cherokee Nation is desirous of participation in the Indian Community Development Block Grant - American Rescue Plan (ICDBG-ARP) program through submission of an application;
WHEREAS, HUD has set out requirements for citizen participation in PIH Notice 2021-22, Section 10(b)(i);
WHEREAS, PIH Notice 2021-22, Section 10(b)(i) waives the following subparts to allow for means other than in-person means to meet the citizen participation requirement: 24 CFR § 1003.604(a)(2), 24 CFR § 1003.604(b), and 24 CFR §1003.305(c)(3);
WHEREAS, the Cherokee Nation is continuously seeking and responding to citizen questions and comments through ongoing processes of the Tribe in order to better serve its citizenry;
WHEREAS, the Cherokee Nation has met the specific requirements of HUD, as specified in PIH Notice 2021-22, Section 10(b)(i), through public notice posted on August 18, 2021, acceptance and consideration of comments, and requests made by respondents;
BE IT RESOLVED BY THE CHEROKEE NATION, that the Tribal Council hereby certifies that Cherokee Nation has met the requirement of HUD set out in 24 CFR § 1003.604(a) regarding Citizen Participation, for the ICDBG-ARP grant application to be submitted for Fiscal Year 2021.
