A RESOLUTION APPROVING AND AUTHORIZING THE SUBMITTAL OF A REQUEST TO THE INDIAN HEALTH SERVICES TO PARTICIPATE IN THE 2024 HIS JOINT VENTURE CONSTRUCTION PROGRAM AGREEMENT FOR CONSTRUCTION AND OPERATION OF THE CLAREMORE HEALTH FACILITY

WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people; and,
WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America; and,
WHEREAS, the Nation has exclusive tribal jurisdiction over the Cherokee Nation Reservation, the geographic scope of which is defined in federal and Cherokee Nation law.
WHEREAS the Cherokee Nation, pursuant to Resolution 57-24 (September 17, 2024), has commenced the Self-Governance planning process regarding the operation of all applicable programs, services, functions and activities (PSFAs) with Indian Health Services at its Claremore Service Unit, to explore the assumption of ownership and operation of the facility by the end of fiscal year 2024; and
WHEREAS as part of its evaluation of Claremore Service Unit, the Principal Chief has advised the Council of a need to plan for a replacement facility for the Claremore Service Unit to expand healthcare access and capacity, with said facility best sited in or in the vicinity of Claremore, Oklahoma; and
WHEREAS, Cherokee Nation wishes to seek the staffing and operations funding for this healthcare facility construction by participating in the Indian Health Service Joint Venture Construction Program; and
WHEREAS, Cherokee Nation agrees to purchase the necessary equipment and provide the construction of the facility to be located in Claremore for this project, subject to the constitutional and statutory authority of the Council with respect to appropriation and oversight of such construction.
